The union knew the NHL wouldn't back down. They made a joke of an offer to rollback salaries 24%. They caved first and agreed to a salary cap, but the NHL wanted a lower one.
I'm not totally on the owners side, there are a few I think should be hanged for getting us into this mess in the first place, but at least they're trying to make it right. The PA didn't make serious negotiations until the last minute.
